The Terms and Conditions shown hereunder relate to the contractual Agreement between "you" (the named individual or Company receiving the Travel Requirement) and American Express Europe limited, "Travel Places"
Travel Requirement
Travel Requirement shall mean any single service or combination of services, including tickets, and other documents, provided by Travel Places to which these Terms and Conditions relate.
Principal
Principal shall mean the carrier(s) or other supplier(s) who is providing the services comprising the travel arrangements. Travel Places acts solely as an agent in making a booking and has no obligation whatsoever to you for the operation of the travel arrangements.
Invoice Details
All invoices issued by Travel Places shall be deemed to be correct and are due for payment by the tenth of the month following the month of invoice. Travel Places reserves the right to impose late payment charges on all invoices outstanding beyond these payment terms. Travel Places reserve the right, at any time, to increase prices in the event of any variation in the cost to them in supplying the same, or any part thereof, caused by any reason whatsoever beyond their control.
VAT
VAT will be charged only where Travel Places is the Principal for the services supplied, and the supply is taxable. Where Travel Places acts as an Agent and passes on the cost of a supply from a Principal to you, this invoice will be tax-inclusive, and a tax invoice from the Principal will be attached as support.
Itinerary Details
Flight and other travel times are provided by the Principal(s) and are subject to change without notice. There is no guarantee that flights, ferries, ships, trains or coaches will depart at the times advised by Travel Places to you or on the tickets you receive.
Insurance
It is your responsibility, to ensure that travellers are adequately insured against loss or injury whilst travelling on business.
Cancellation or Change of Travel Arrangements
If you cancel or change any of the arrangements made on your behalf, please contact Travel Places as soon as possible. You will be liable for any amendment or cancellation fees levied by the Principal(s).
Passports Visa and Health Requirements
You will have been advised at the time of booking of the Passport Visa and Health Requirements for the Travel Requirements booked. It is your responsibility to ensure that you and those in your party have the appropriate documentation for the country(ies) to which you intend to travel. You will be responsible for any additional costs incurred whether by you, or by Travel Places on your behalf resulting from your failure to comply with necessary requirements.
Travel Places Responsibility
Travel Places has taken all reasonable steps to ensure the suppliers with whom we do business are reputable and efficient and comply with the laws of the country in which they operate. Travel Places has also taken all reasonable care in making the travel arrangements sold to you and accepts responsibility for ensuring that there are no deficiencies in the services we are contractually obliged to provide and that they are provided to reasonable standards. If they are not we will pay reasonable compensation except where there has been no fault on our part or that of our suppliers and the cause was your own fault, the actions of a third party unconnected with the travel arrangements, or could not have been foreseen or avoided by Travel Places or our suppliers even if all due care had been exercised. In the case of air travel, rail travel, sea travel, road or hotel accommodation Travel Places limits its liability to compensate you under this section to the amount specified in the Warsaw Convention as amended by the Hague Protocol 1995, the 1961 Berne Convention, the 1974 Athens Convention, the 1977 Geneva Convention and the 1962 Paris Convention respectively, unless varied by the Principal publicly.
Where we accept responsibility under this section it is a requirement that you:
I) assign to us your rights against the person or persons responsible so that we may be subrogated to those rights and claim in your place. 2) will co-operate fully (at Travel Places' expense) should we or our insurers wish to enforce those rights. In the event that we recover an amount exceeding any payment made to you and our costs and those of our insurers please be assured any excess will be paid to you.
Law and Jurisdiction
All matters concerning any booking and these Terms and Conditions shall be subject to English law and the jurisdiction of the Courts of England and Wales.
